Terms of Use

Agreement to these terms

These Terms of Use are an agreement between you and Vitality Testosterone Replacement Therapy, which operates Vitality Testosterone Replacement Therapy ("Vitality", "we", "us"). By using this website, the assessment and booking site, or our phone, text and email services, you agree to these terms.

If you do not agree, please do not use the services. Our Privacy Policy, Consumer Health Data Privacy Policy, Telehealth Consent, Stopping care and payments and SMS Terms are part of these terms.

Who provides what

Vitality Testosterone Replacement Therapy provides administrative and technology support: the website, scheduling, care coordination, billing and customer service. It does not practice medicine.

Medical services are provided by independently licensed physicians, nurse practitioners and physician assistants of our affiliated medical practices and their affiliated professional entities. All treatment decisions are made at the sole discretion of the treating provider. Medications are dispensed by licensed pharmacies. Your care coordinator is not a clinician and does not give medical advice. More detail is on Who provides care.

Not for emergencies

The services are not for emergencies or urgent care. If you have a medical emergency, call 911 or go to the nearest emergency room.

Messages, voicemails and assessment answers are not monitored around the clock. Do not use them to report urgent symptoms.

Who can use the services

You must be at least 18, and you must live in and be physically located in a state where the affiliated medical practices provide the service you are asking about. Services are available only in states where our providers are licensed.

You agree to give true, complete and current information about yourself and your health, including your state of residence, and to update it when it changes. A provider relies on that information to make safe decisions.

No promise of treatment

Paying for lab work or a provider visit pays for an evaluation. It does not buy a prescription or any particular result.

Prescription treatment requires an evaluation by a licensed healthcare provider, who decides whether treatment is appropriate for you. Not everyone qualifies. Completing an assessment, booking a visit, or paying a fee does not guarantee a prescription.

A provider may decide that treatment is not appropriate, may change or stop a treatment, or may refer you elsewhere. Individual results vary.

Your information and your account

You are responsible for keeping any login details, links and codes we send you private, and for activity that happens with them. Tell us right away at (866) 744-0454 if you think someone else has used them.

How we handle personal and health information is described in the Privacy Policy and the Consumer Health Data Privacy Policy.

Costs, payment and stopping

You pay for each step as you reach it: lab work, a provider fee that covers your provider's visits and reviews for a set period, and, if a provider prescribes treatment, a medication supply that is paid in full up front for a set period. There is no membership, no long-term contract and no automatic billing.

Your coordinator explains each cost before you pay, and you get a receipt by email. Each new supply needs your provider's prescription and your OK. You can stop at any time by not ordering your next supply. Ask your coordinator before you pay how a payment is handled if you stop. Because you pay for your own care, you receive a written Good Faith Estimate when a lab panel, a provider visit or a medication supply is scheduled, and you can ask for one at any time.

You agree to pay the amounts you approve, and you authorize us to charge the payment method you give us for those amounts only.

Messages from us

We contact you by phone and email about your requests, appointments, lab orders, orders and payments. Texts are sent only if you agree to them as described in our SMS Terms. Marketing messages are sent only with your separate consent.

Text messages are covered by our SMS Terms. Reply STOP to stop texts at any time. Calls may be recorded for quality, and you are told at the start of a recorded call.

Acceptable use

Use the services only for lawful purposes and only for yourself. Do not book or answer questions on behalf of someone else unless you are their legal representative.

You agree not to: give false information; try to get a prescription for someone else; resell or share any medication; interfere with or probe the security of the services; copy or scrape the website; or use the services to harass anyone, including our staff and the providers.

Content and trademarks

Disclaimers

We provide the website and our administrative services "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the website will be uninterrupted or without errors, or that general information on it is complete or current for your situation. Nothing in these terms limits any duty a licensed provider owes you under professional standards or state law.

Limits on liability

To the extent the law allows, Vitality Testosterone Replacement Therapy is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the website or our administrative services.

To the extent the law allows, our total liability for any claim about the website or our administrative services is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability that cannot be limited by law, and they do not limit claims about medical care, which are between you and the treating provider's practice.

Indemnity

You agree to cover our reasonable losses and costs from claims caused by your breach of these terms or your misuse of the services, to the extent the law allows. This does not apply to claims caused by our own fault.

Disputes and governing law

Nothing here stops you from contacting your state attorney general, medical board or another regulator.

Changes to these terms

We may update these terms. The new version is posted here with a new effective date, and material changes are announced on the website or by email before they take effect.

Changes do not apply to a payment you approved before the change.
